TERMS OF USE & CONTENT PROTECTION POLICY

Welcome to Caferotica. By accessing or using caferotica.com, you agree to comply with these Terms of Use and Content Protection Policy. These terms are intended to protect our artwork, creative projects, customers, photographers, models, collaborators, and intellectual property.

Caferotica is a brand owned and operated by Believe in Boudoir LLC, a Florida limited liability company. Throughout this Privacy Policy, the terms “Caferotica,” “we,” “us,” and “our” refer to Believe in Boudoir LLC, doing business as Caferotica. This policy applies to the Caferotica website at caferotica.com and its associated products and services.

If you do not agree to these terms, you must discontinue use of the website.

1. ADULT CONTENT AND ELIGIBILITY

Caferotica features erotic fine art photography, artistic nudity, fictional adult characters, and other mature themes. The website's adult-oriented content is intended exclusively for individuals aged 18 or older who are legally permitted to access such material in their jurisdiction.

All visitors are responsible for complying with applicable local laws. Caferotica reserves the right to restrict access to its services where appropriate or legally required.

2. COPYRIGHT AND OWNERSHIP OF ARTWORK

Photographs, photographic prints, videos, written stories, character descriptions, original graphic designs, branding, product presentations, and other creative materials displayed on Caferotica may be protected by copyright, trademark, and other applicable intellectual property laws.

Unless expressly stated otherwise, Caferotica or its respective licensors retain all applicable rights in these materials. Some materials may incorporate AI-generated elements, for which the scope of intellectual property protection may differ under applicable law.

Purchasing an artwork, print, collectible card, or other physical product transfers ownership of the purchased item, not the copyright or commercial reproduction rights in the underlying artwork.

No intellectual property license is granted except as expressly stated in these terms or separately authorized in writing.

3. SCREENSHOTS, COPYING, AND UNAUTHORIZED DISTRIBUTION

Caferotica prohibits the unauthorized reproduction, systematic screenshotting, downloading, recording, extraction, redistribution, or commercial exploitation of protected website content.

In particular, visitors must not reproduce or distribute artwork for unauthorized commercial purposes, create competing products from our images, remove copyright notices or watermarks, or distribute copies of protected content through websites, social media accounts, file-sharing services, or other platforms without authorization.

Limited uses permitted by applicable law, including legally protected fair use, are not prohibited by this policy. Merely accessing an image online does not grant permission to reproduce, sell, license, or redistribute it.

4. ZERO TOLERANCE FOR HARASSMENT OF MODELS AND ARTISTS

Caferotica maintains a zero-tolerance policy toward harassment, stalking, threats, intimidation, coercion, exploitation, or abuse directed at any model, photographer, artist, employee, collaborator, or individual associated with our creative work.

Visitors must not use information obtained through Caferotica to pursue unwanted personal contact, threaten individuals, make abusive or sexually coercive communications, disclose private personal information, or organize targeted harassment campaigns.

Appearing in an erotic photograph does not constitute consent to personal contact, sexual advances, harassment, exploitation, or violations of personal boundaries.

We reserve the right to suspend services, cancel accounts where permitted, block access, preserve evidence, report misconduct to relevant platforms, and pursue available legal remedies when appropriate.

5. PROTECTION AGAINST DOXXING AND INVASION OF PRIVACY

Visitors must not use Caferotica content to unlawfully obtain, publish, or distribute private personal information about individuals associated with our projects.

This includes attempts to expose private addresses, personal contact details, family information, confidential records, or other nonpublic identifying information for harassment, intimidation, exploitation, or other unlawful purposes.

Unauthorized impersonation of models, artists, fictional characters, or Caferotica representatives is prohibited.

6. AI TRAINING, FACE MANIPULATION, AND SYNTHETIC CONTENT

Except where expressly authorized or legally permitted, Caferotica prohibits the extraction or use of its protected photographic content for developing, training, fine-tuning, or distributing artificial intelligence models and datasets.

Visitors must not use our photographs to create unauthorized commercial deepfakes, deceptive impersonations, synthetic sexual imagery of real individuals, or manipulated material intended to harass, defame, exploit, or misrepresent a person.

The fact that Caferotica uses AI-assisted imagery for fictional character storytelling does not grant visitors permission to appropriate our protected photographic works or misuse the likenesses of real people.

7. FICTIONAL CHARACTERS AND REAL PHOTOGRAPHY

Caferotica's fictional characters are artistic creations developed for storytelling and entertainment. Character profiles, biographies, personalities, occupations, relationships, and associated fictional narratives are not representations of the actual identities or personal lives of the models appearing in our photography.

AI-generated character imagery may be used for fictional storytelling and promotional presentation. Our collectible photographic artworks are presented as works created through photography with real people, subject to the specific product descriptions.

Visitors must not knowingly misrepresent fictional narratives as verified personal information about actual models or use such narratives to harass, impersonate, or defame real individuals.

8. PHOTOGRAPHIC PRINTS AND COLLECTOR RIGHTS

Caferotica offers photographic artworks in various editions, formats, and quantities. Edition limits, print sizes, materials, production methods, and collectible characteristics are governed by the relevant product descriptions and applicable purchase terms.

Purchasing a limited-edition photograph does not grant the buyer the right to reproduce the artwork, create derivative merchandise, issue additional editions, or commercially license the image.

Collectors may display, resell, or otherwise exercise lawful ownership rights over their purchased physical artwork, subject to applicable law and any valid contractual restrictions.

Caferotica works with independent printing and fulfillment partners to produce our fine art photography. While all artwork offered through Caferotica is intended for artistic and collectible purposes, certain printing providers may decline to reproduce specific images because of nudity, adult subject matter, or their internal content policies. We respect the right of our production partners to establish and enforce their own printing restrictions.

If a printing partner refuses to fulfill an artwork order for these reasons, Caferotica will contact the customer and offer an alternative: an original photographic print produced through our traditional darkroom process, subject to availability and production feasibility.

Any differences in print size, materials, framing, appearance, production time, shipping, or pricing will be communicated before the customer accepts the alternative. We will not substitute a different product without the customer's consent.

If the customer declines the alternative or we are unable to produce an acceptable replacement, Caferotica will provide a refund for the affected item, including applicable shipping charges, in accordance with applicable law.

This provision does not limit any statutory cancellation, refund, or consumer protection rights.

9. PROTECTION OF COLLECTIBLE CARDS

Caferotica collectible cards are physical artistic products associated with our coffee and collectible offerings. Their photographs, original designs, written content, and branding may be protected by intellectual property laws.

Customers may photograph their legitimately purchased cards for lawful personal purposes, including ordinary collection documentation and resale listings. However, ownership of a card does not authorize commercial reproduction of protected artwork, counterfeit card production, unauthorized licensing, or distribution of digital reproductions in violation of applicable law.

We reserve the right to take appropriate action against counterfeiting, fraudulent collectible listings, and unauthorized commercial exploitation.

10. UNAUTHORIZED SCRAPING AND AUTOMATED EXTRACTION

Visitors must not use bots, crawlers, scraping systems, automated download tools, or similar technologies to extract substantial amounts of protected content, interfere with website operations, circumvent access restrictions, or collect personal information without authorization, except as permitted by applicable law.

Caferotica may implement technical controls to protect website performance, content, and security.

11. REPORTING COPYRIGHT INFRINGEMENT AND ABUSE

If you believe Caferotica content has been copied, distributed, misused, or used to harass an individual, please contact info@caferotica.com with relevant details.

Reports should identify the material or conduct involved, the location where it appears, and sufficient information to allow us to review the concern. Do not send sensitive personal information unless reasonably necessary.

Where appropriate, Caferotica may submit copyright takedown requests, report violations to hosting providers or social media platforms, seek legal advice, or pursue available civil remedies.

12. ENFORCEMENT AND RESERVATION OF RIGHTS

Caferotica reserves the right, subject to applicable law, to investigate suspected violations, restrict access, refuse service, suspend accounts, remove submitted content, and take reasonable measures to protect its intellectual property and associated individuals.

We may preserve relevant records and cooperate with lawful investigations when necessary and permitted by law.

Violations may result in legal action where appropriate. Nothing in these terms creates an automatic entitlement to damages, penalties, or remedies beyond those available under applicable law.

13. NO WAIVER OF LEGAL RIGHTS

Nothing in these terms is intended to restrict lawful criticism, commentary, reporting, fair use, statutory consumer rights, or other rights that cannot legally be waived.

If any provision is determined to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
